Recent ruling: United States Court of Appeals for the Fifth Circuit

In 2023, the firm was involved in a federal court trial claiming the City of Houston's regulatory denial of permits which were requested by our client to repair its thriving apartment complex damaged by Hurricane Harvey flooding constituted a “regulatory” taking for which damages were owed. The trial court rejected the claim and found no taking. In 2025, the Fifth Circuit Court of Appeals found that there was indeed a regulatory taking and sent the case back down to the trial court for further proceedings to determine the amount of compensation owed to our client. This was a huge win for our client and an important case that will likely be cited nationwide in property rights takings cases
